The Government's Preferred Options for Reform of the Real Estate Agents Act 1976

The Associate Minister of Justice Clayton Cosgrove instructed the Ministry of Justice to undertake a comprehensive review of the Real Estate Agents Act 1976. This review has been prompted by recent concern about the effectiveness of the complaints and disciplinary regime for real estate agents. Concern has also been expressed about the adequacy of entry and annual licensing requirements, the availability of consumer redress, and general regulation of real estate activity.

The consultation document

The consultation document  (PDF Adobe Acrobat v6 1178KB), which builds on earlier work, contains draft proposals to be contained in new legislation which will replace the current Act. We invite you to make written submissions on these proposals using the form provided. If you cannot view this form, the questions for submissions are set out in full at the rear of the consultation document.

Once your submissions have been considered, we will develop final proposals. The proposals will then go to government for approval. If they are approved they will form the basis for the new legislation for real estate agents.
