How to file a claim with the Weathertight Homes Tribunal, including tips on how to prepare.
To find out if you have a legitimate claim to take to the Weathertight Homes Tribunal, talk to a claims advisor at the Department of Building and Housing. If they think you have a valid claim they can help you prepare and file the claim.
Before you start
Before filling out an application form all claimants, respondents, expert witnesses and legal representatives are strongly advised to read the Chair's Directions. These outline the procedures and legal requirements for proceeding with a claim. Failing to follow these directions can cause delays.

Application form
The first step is to download and complete the correct application form:

Copies of documents
Along with your completed application you must file the following documents in both electronic format and hard copy:
- Department of Building and Housing's full assessment report, or, if the home has been repaired, a copy of the eligibility assessment report with the receipts from the repairs.
- A copy of the notification from the Department that the claim is eligible.
- If the claim is for $20,000 or less, a copy of the Department's lower-value claim dispute resolution certificate.
- Correct names and current addresses (if possible) for the people, companies or entities the claim is being made against.
- Copies of invoices, quotes or estimates on which the claim is based if other than assessors report.
- A list of relevant documents that may be needed so copies can be supplied on request.
- Any other report or information that will be used to support the claim.

You’ll also need to include the $408.89 fee made payable to the Ministry of Justice and sent to:

Case manager assigned
Once the claim has been registered by the Tribunal, a member of the Tribunal and a case manager will be assigned to the claim, and all parties will be informed. Any queries about the adjudication process can then be made to the case manager.
